Waste Clearance Sutton Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Sutton provides waste clearance and related services to domestic and commercial customers. By placing a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, firm or company requesting services from Waste Clearance Sutton.

Services means waste clearance, waste collection, rubbish removal, house clearance, garden waste removal, office clearance, bulky waste removal, and any related services provided by Waste Clearance Sutton.

Waste means any materials, items, rubbish or goods to be removed, transported or disposed of as part of the Services.

Contract means the agreement between Waste Clearance Sutton and the Customer comprising these Terms and Conditions, the booking confirmation and any written quotation.

2. Scope of Services

Waste Clearance Sutton provides waste collection and clearance services within its operational service area, which includes Sutton and surrounding locations, subject to availability. The specific Services to be provided, and the applicable charges, will be confirmed at the time of booking or in a written quotation.

Services are offered on the basis that the Waste is non-hazardous, suitable for manual handling by our operatives, and acceptable for transport and disposal at licensed facilities in accordance with applicable waste regulations.

3. Booking Process

3.1 Bookings can be requested by telephone or email. A booking is not confirmed until Waste Clearance Sutton issues a booking confirmation, which may be provided verbally or in writing, and allocates a date and time window for the collection.

3.2 The Customer must provide accurate information about the type, quantity and location of the Waste, site access, parking arrangements, and any other relevant details that may affect the performance of the Services. Quotations and time estimates are based on the information supplied by the Customer at the time of booking.

3.3 Waste Clearance Sutton reserves the right to refuse or cancel a booking where the Waste is found to be hazardous or unsuitable, where access is unsafe, or where the information provided by the Customer is materially inaccurate.

3.4 Any changes to the booking details, including changes to the volume or type of Waste, property access, or collection time, must be communicated to Waste Clearance Sutton as soon as reasonably practicable. Additional charges may apply where the scope of the Services increases or where extra time on site is required.

4. Quotations and Pricing

4.1 Quotations are usually provided based on the estimated volume or weight of Waste, the labour required, access conditions and disposal costs. All quotations are subject to inspection of the Waste on arrival and do not constitute a final price until the Waste has been assessed by our operatives.

4.2 If, upon arrival, the Waste is significantly different in type, volume, weight or location from that originally described, Waste Clearance Sutton may revise the quotation. The Customer will be informed of any change in price before work proceeds. If the revised price is not accepted, we reserve the right to cancel the Service and charge a call-out or minimum attendance fee.

4.3 Unless otherwise stated, all prices are quoted in pounds sterling and are inclusive or exclusive of VAT depending on the status of the business, which will be made clear to the Customer at the time of booking.

5. Payments

5.1 Payment is due in full on completion of the Services on the day of collection, unless alternative payment terms have been agreed in writing in advance.

5.2 We accept common forms of payment, such as cash, major debit and credit cards, and bank transfer. Where payment is made by bank transfer, cleared funds must be received within the agreed timeframe.

5.3 For commercial customers with approved accounts, invoices are payable within the agreed credit period from the date of the invoice. Waste Clearance Sutton reserves the right to charge interest on overdue amounts in accordance with applicable UK legislation on late payment of commercial debts.

5.4 Waste Clearance Sutton reserves the right to withhold or suspend Services where payment terms have not been met, or where there are outstanding overdue balances on the Customer's account.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or reschedule a booking by providing at least 24 hours' notice prior to the agreed arrival window. Cancellations or rescheduled bookings made with less than 24 hours' notice may be subject to a cancellation fee or minimum charge at the discretion of Waste Clearance Sutton.

6.2 If our operatives attend the property at the agreed time and are unable to gain access, unable to park legally and safely, or the Customer is not present where required, this may be treated as a same-day cancellation and a call-out or minimum charge may apply.

6.3 Waste Clearance Sutton may cancel or reschedule a booking at any time where it is not reasonably practicable to carry out the Services due to reasons beyond its control, including severe weather, traffic incidents, vehicle breakdown, staff illness, or health and safety concerns. In such cases, we will endeavour to offer the Customer an alternative date and time. Waste Clearance Sutton shall not be liable for any loss arising from such cancellations or delays, save for the refund of any prepaid charges for Services not provided.

7. Customer Obligations

7.1 The Customer must ensure safe and reasonable access to the Waste and to the property, including any required parking permits or arrangements. Any parking charges or fines incurred as a direct result of the Customer's failure to provide suitable parking may be added to the invoice.

7.2 The Customer must separate and identify any Waste that may be hazardous or require special handling and must not knowingly conceal hazardous substances, sharp objects, pressurised containers, liquids, asbestos, chemicals or clinical waste within general rubbish.

7.3 The Customer is responsible for obtaining any permissions, consents or approvals required from landlords, managing agents, neighbours or local authorities for the clearance, access or temporary placement of waste containers, skips or vehicles.

7.4 Where the Customer requests removal of items from within a building, the Customer must ensure that all pathways and stairways are clear and safe, and that any fragile surfaces are protected as necessary.

8. Waste Regulations and Duty of Care

8.1 Waste Clearance Sutton operates in accordance with applicable UK waste management legislation, including duty of care obligations relating to the handling, transport and disposal of controlled waste.

8.2 The Customer confirms that they are the owner of the Waste, or are authorised by the owner to arrange its removal and disposal, and that the Waste was produced in compliance with relevant laws and regulations.

8.3 Waste Clearance Sutton will take reasonable steps to ensure that Waste is transported to licensed waste transfer stations, recycling centres or disposal facilities. Where a waste transfer note is required by law, it may be completed and retained in accordance with regulatory requirements. Copies may be provided to the Customer upon request where applicable.

8.4 The Customer must not request the removal of any Waste that is prohibited or requires specialist licences, such as asbestos, certain chemicals, medical waste, gas bottles or other regulated materials, unless this has been specifically agreed in writing in advance.

9. Liability and Limitations

9.1 Waste Clearance Sutton will exercise reasonable care and skill in providing the Services. However, the Customer accepts that minor scuffs or marks may sometimes occur during the movement of heavy or bulky items, particularly in confined spaces. The Customer is responsible for protecting floors, walls, surfaces and fixtures as they deem appropriate.

9.2 Waste Clearance Sutton shall not be liable for any pre-existing damage to property or items, nor for damage arising from inherent defects, unsafe structures, or items that are already fragile or in poor condition.

9.3 Where the Customer requests the removal of items that are fixed, built-in or connected to utilities, such as kitchen units, appliances or fitted furniture, the Customer is responsible for ensuring that all relevant services are safely disconnected, and that removal will not breach building regulations or warranties. Waste Clearance Sutton accepts no liability for any resulting damage to plumbing, electrics, gas installations or structural elements unless caused by our negligence.

9.4 To the fullest extent permitted by law, Waste Clearance Sutton shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of data, arising out of or in connection with the Services.

9.5 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

10. Insurance

10.1 Waste Clearance Sutton maintains appropriate public liability and, where relevant, employer's liability insurance for the provision of waste clearance and collection services.

10.2 The Customer may request confirmation of current insurance cover. Any claim for loss or damage must be notified to Waste Clearance Sutton in writing as soon as reasonably practicable and, in any event, within 7 days of completion of the Services, giving full details of the circumstances and the alleged loss.

11. Time Slots and Delays

11.1 Any time or date indicated for arrival or completion of the Services is an estimate only. While Waste Clearance Sutton endeavours to attend within the agreed time window, delays may occur due to traffic, weather, operational issues or other circumstances beyond our reasonable control.

11.2 Waste Clearance Sutton shall not be liable for any loss or expense incurred by the Customer as a result of a delay or failure to attend at the estimated time, provided that we use reasonable endeavours to keep the Customer informed and to rearrange the booking where necessary.

12. Title and Ownership of Waste

12.1 Once Waste has been removed from the Customer's premises and loaded onto our vehicle, ownership of that Waste transfers to Waste Clearance Sutton or to the relevant licensed carrier or facility, subject to applicable waste regulations.

12.2 The Customer acknowledges that items removed as Waste may be disposed of, recycled, recovered or resold where lawful, and that no claim can be made for any residual value in items once they have been collected as part of the Services.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with Waste Clearance Sutton as soon as possible, providing full details and any supporting evidence.

13.2 Waste Clearance Sutton will investigate complaints in a fair and timely manner and may request access to the property or relevant documentation to assess the situation. Where a complaint is upheld, we may, at our discretion, offer a remedy such as a partial refund, rectification of the issue, or a goodwill gesture.

14. Data Protection and Privacy

14.1 Waste Clearance Sutton will collect and process personal data such as names, contact details, addresses and payment information for the purpose of administering bookings, providing Services, handling payments, and complying with legal obligations.

14.2 Personal data will be handled in accordance with applicable UK data protection laws. Information may be shared with third parties only where necessary for service delivery, payment processing, legal compliance or as required by law.

15. Variations to Terms

15.1 Waste Clearance Sutton reserves the right to update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the Contract, unless a change is required by law or regulatory authority.

15.2 Any variation to these Terms and Conditions requested by the Customer will only be effective if agreed in writing by an authorised representative of Waste Clearance Sutton.

16. Severability

16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, such provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Waste Clearance Sutton.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between Waste Clearance Sutton and the Customer and supersede any prior discussions, correspondence or representations relating to the Services.

18.2 The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of Waste Clearance Sutton that is not set out in these Terms and Conditions.
